Maryland’s Grounds for Divorce

In the state of Maryland, spouses can file for divorce for three different reasons:

1. Six-Month Separation

The court may grant a divorce if the parties have pursued separate lives for six months without interruption before filing for divorce. Previously, the law stated that couples had to live entirely separate lives for 12 months to be granted a divorce, and not only does the new law reduce that period to six (6) months, but it also removes the “residing separately” requirement, as many couples seeking divorce still live in the same home. Reasons such as the financial strain of running two separate households and easy co-parenting often keep couples in the same home during this process.

2. Irreconcilable Differences

A divorce can be obtained based on irreconcilable differences. This allows couples to seek divorce without needing to prove their spouse committed any wrongdoing. This process can be significantly more straightforward than the old divorce laws that required a fault ground, such as proving adultery.

3. Mutual Consent

3. Care, custody, access, and support of minor or dependent children

CONTESTED DIVORCE

In a contested divorce, there is at least one issue over which the parties have a disagreement. The issue could be custody of the children or division of assets, just to name a few. In an uncontested divorce, there are no issues in dispute. In this situation, the parties just want to be divorced and they have been physically separated for over one (1) year prior to filing OR a Marital Separation Agreement has been signed and notarized. If all assets have been divided or an agreement has been reached on how to divide the assets, any issues on custody, access and child support have been determined and agreed to by the parties, and alimony has been agreed upon or waived, then the case is uncontested. At that point, the Court proceeding is streamlined, as there are no issues being contested.
